The Clean Air Act (CAA) requires SIPs to include contingency measures which are triggered if an area fails to meet any applicable milestone or fails to attain an air quality standard by the attainment date. A comprehensive SIP addressing the 2008 ozone standard in the Coachella Valley was previously submitted to U.S. EPA as part of the 2016 AQMP. However, due to recent court actions, the contingency measures in the 2016 AQMP are no longer approvable. In 2022, South Coast AQMD withdrew the applicable contingency measure elements for the 2008 ozone standard in the Coachella Valley to avoid potential disapproval by U.S. EPA. Following release of U.S. EPA’s draft guidance on contingency measures in 2023, staff developed the Coachella Valley Contingency Measure SIP Revision for the 2008 8-Hour Ozone Standard for submission to U.S. EPA via CARB. The SIP Revision is needed to stay the stationary source permitting sanction clock in the Coachella Valley, which is due to expire on April 30, 2024.
