Rule 1148.2 Chemical Report - Supplier

This is the chemical reporting tool to assist suppliers in complying with the requirements of Rule 1148.2(e)(3). Suppliers of chemicals used in oil/gas well operations must use this electronic format (approved by the SCAQMD Executive Officer) to report trade secret chemical information no later than 60 days after delivery of the chemicals to an operator conducting oil/gas well drilling, well completion, or well rework activities.

NOTE:  Navigating away from the data input webpage (i.e., clicking the “Back” button or the “refresh” button) during the data entry process will delete any information that has not been saved.  If you are unable to submit a complete report at one time, you may save your work in progress, or submit separate partial Chemical Reports for the same Event ID number.  To save a partially completed form, you must provide a minimum amount of information (at minimum, you must complete all fields in the “Supplier Information” section, provide a valid Event ID number, complete all fields for at least one trade secret chemical, and you must click the “I agree to the Above Certification Statement” checkbox, before you will be allowed to save a partial form), then you can click the “Save” button at the bottom of the page.  To return to your saved form, go back to the Reporting Portal and click on the “Edit Saved Supplier Report” button.  Also, if no user activity occurs on the data input page for more than 20 minutes, the system will automatically “log-out” without saving the information.

Chemical Reporting Instructions for Suppliers

To begin entering information into the Chemical Report –Supplier Form, first enter the “Event ID” number for the event to be referenced in the report.  The “Event ID” number may be found on the Rule 1148.2 Notification Form confirmation email that was sent by SCAQMD  following submittal of an applicable well drilling/completion/rework event Notification Form.  If you do not have the Event ID number, you may obtain it by contacting the Well Operator, or you can search for it here.  

Upon entering the Event ID number, please verify that all of the Operator and Well information  is correct.  If it is not correct, verify that you have entered the correct Event ID number and/or view the original Notification Form to verify that the information on the form matches with the event for which you are reporting chemical information.  Correct each field which is not accurate.

Complete the "supplier information" section with identity of your business name, location, and contact information.

Entering Trade Secret Chemical Information

The recently amended rule mandates that the reporting forms separate the trade name products from their individual chemical ingredients.  Thus, you will notice that the information on trade name products is not tied to the chemical information.  In addition, the chemical reporting process is segregated into SB4 and non-SB4 related well activities.  This is necessary because of the different requirements on what can be claimed as trade secret and what is required to be reported.  To enter information for any section click the "Add" button.  Repeat this process any time you have more than one trade name product, chemical, or other entry until all ingredients are reported.
 

Trade Name Products you claim as Trade Secret:

Provide:

1.  The product name, common name, or commercial name of the well drilling/completion/rework fluid trade name product. Example: “Rubbing alcohol” or “isopropyl alcohol” are common names for isopropanol.

2.  Include the total mass and purpose of all the trade name products you identified to the operator as trade secret.

3.  Identify the well activity type by choosing from the drop-down box. 

Trade Name Products - Your Supplier Claims as a Trade Secret:

This section is to be completed if you have a secondary supplier who claims the mass of a trade name product as trade secret.  Under Rule 1148.2, only the mass of the trade name product may be claimed as trade secret.

Provide:

1.  The product name, common name, or commercial name of the well drilling/completion/rework fluid trade name product. Example: “Rubbing alcohol” or “isopropyl alcohol” are common names for isopropanol.

2.  Include the purpose of all the trade name products you identified to the operator as trade secret.

3.  Identify the well activity type by choosing from the drop-down box.

4.  Check if your secondary supplier provided a statement claiming trade secret protection. 

 

Required Information for Chemicals You Claimed as Trade Secret for Both SB4 and non-SB4 Well Activities:

Provide:

1.  The chemical name of each ingredient of the well drilling/completion/rework fluid trade name product.  Example:  isopropanol and water are chemical names for typical ingredients in isopropyl alcohol.

2.  Provide the total mass, in pounds (lbs), of the chemical used.  You can either report them independently (if they appear in more than one trade name product) or sum the individual amounts in each trade name product and provide the total amounts in the well fluid.

3.  Choose yes or no from the drop down box if the chemical ingredient is listed on the CARB Air Toxics list found here.

4.  Provide the "Chemical Abstract Service" number for the applicable chemical ingredient.  NOTE:  All CAS numbers must be entered in the appropriate format (i.e., three parts separated by hyphens- the first part consisting of seven digits, the second consisting of two digits, and the third part consisting of one digit).  If there are less than seven digits in the first part, enter leading zeroes before the first part of the CAS number.  Example:  Isopropanol CAS number is 67-63-0.  This CAS number would be entered as "0000067-63-0".  If there is no CAS number available for the applicable chemical ingredient, enter "0000000-00-0".

5.  The chemical family name provided to the operator for this chemical ingredient.

6.  From the drop down box, select the well activity type.

7.  Provide a written "Basis for Trade Secret Protection" for each chemical.  State (1) the extent to which the information is known outside the person's business; (2) the extent to which it is known by employees and other involved in the person's business; (3) the extent of measures taken by the person to guard the secrecy of the information; (4) the value of the information to the person's business and to the person's competitors; (5) the amount of effort or money expended by the person in developing the information; and (6) the ease or difficulty with which the information could be properly acquired or duplicated by others.  Only information claimed to be a trade secret at the time of submittal to the SCAQMD may be treated as a trade secret.  Note:  One statement for all chemicals may suffice.

Required Information for Chemicals Claimed as Trade Secret by Your Supplier for SB4 Well Activities:

Complete this section if you have a secondary supplier claims trade secret for chemicals used in an SB4-related well activity.

Provide:

1.  The chemical name of each ingredient of the well drilling/completion/rework fluid trade name product.  Example:  isopropanol and water are chemical names for typical ingredients in isopropyl alcohol.

4.  From the drop down box, select the well activity type.

5.  Check the box if your secondary supplier provided a statement claiming trade secret protection.

Other Supplier Name:

Provide the name, address, and contact information for the secondary supplier who supplied the well drilling/completion/rework fluid trade name product for the applicable well event (if supplied by a company other than your company).
