    A. Determine That Proposed Rule 317.1 – Clean Air Act Nonattainment Fees for 8-Hour Ozone Standards Is Not Considered Subject to CEQA; and Adopt Rule 317.1

    Sections 185 of the federal Clean Air Act, as amended in 1990, requires major stationary sources of NOx and VOC located in air basins that do not attain a federal 8-hour ozone standard by the statutory deadline to pay fees based upon a prescribed formula each year until the NAAQS is attained. Proposed Rule 317.1 – Clean Air Act Nonattainment Fees for 8-Hour Ozone Standards (PR 317.1) would implement these Clean Air Act requirements for the 1997 and 2008 8-hour ozone standards. The provisions of PR 317.1 would address when and how the CAA nonattainment fees would be assessed and collected. This action is to adopt the Resolution: 1) Determining that Proposed Rule 317.1 – Clean Air Act Nonattainment Fees for 8-Hour Ozone Standards, is not considered a project subject to the requirements of the California Environmental Quality Act; and 2) Adopt Rule 317.1 – Clean Air Act Nonattainment Fees for 8-Hour Ozone Standards.     B. Certify Final Environmental Assessment for Proposed Amended Rule 463 – Organic Liquid Storage; and Amend Rule 463

    Proposed Amended Rule 463 (PAR 463) establishes enhanced leak detection using optical gas imaging OGI, more stringent control requirements to dome external floating roof tanks, and other requirements. Additionally, PAR 463 will include contingency measures for both the Coachella Valley and the South Coast Air Basin, which will require more frequent use of optical gas imaging, if triggered. This action is to adopt the Resolution: 1) Certifying the Final Environmental Assessment for Proposed Amended Rule 463 – Organic Liquid Storage; and 2) Amending Rule 463 – Organic Liquid Storage.     C. Determine That South Coast Air Basin Attainment Plan for 2012 Annual PM2.5 Standard Does Not Require A New Environmental Document; and Adopt South Coast Air Basin Attainment Plan for 2012 Annual PM2.5 Standard

    The South Coast Air Basin is designated as “serious” nonattainment for the 2012 Annual PM2.5 national ambient air quality standard. A plan to attain this standard was originally submitted to U.S. EPA in 2017 but was withdrawn due to U.S. EPA’s delay in considering that plan, and availability of new air quality data taken near roadways. Subsequently, a new plan was developed to satisfy State Implementation Plan requirements. The control strategy in the 2022 AQMP and limited controls for PM2.5 and its precursor are expected to lead to attainment of the 2012 Annual PM2.5 standard by December 31, 2030. This action is to adopt the Resolution: 1) Determining that the South Coast Air Basin Attainment Plan for the 2012 Annual PM2.5 Standard is a later activity within the scope of the Final Program Environmental Impact Report (EIR) for the 2022 AQMP and the Final Program EIR for the 2016 AQMP such that no new environmental document will be required; and 2) Adopting the South Coast Air Basin Attainment Plan for the 2012 Annual PM2.5 Standard, and directing staff to forward the Attainment Plan to CARB for approval and submission to U.S. EPA for inclusion in the SIP.     3. Transfer Funds Between Major Objects, Issue Solicitations and Purchase Orders for AQ-SPEC Program

    The AQ-SPEC Program performs systematic, detailed characterizations of currently available air monitoring sensors using both field and laboratory-based testing and communicates the results to the public. AQ-SPEC funds are included as part of Monitoring & Analysis’ FY 2023-24 adopted budget. Based on an assessment of the priorities and resources of this program, there is a need to reallocate funds for enhancing VOC sensor testing capabilities. This action is to transfer up to $47,000 between Major Objects, and issue solicitations and purchase orders for air monitoring equipment.   • 4. Recognize Revenue, Appropriate and Transfer Funds, Issue Solicitation and Purchase Order for One Vehicle

    South Coast AQMD is expected to receive grant funds up to $2,200,000 from the U.S. Government for the Enhanced Particulate Monitoring Program. This action is to recognize revenue, appropriate and transfer funds between Major Objects in Monitoring and Analysis Budget to realign expenditures, and issue a solicitation and purchase order for one vehicle.   • 5. Recognize Funds, Execute Agreements for School Air Filtration Systems in Environmental Justice Communities, and Reimburse General Fund for Administrative Costs

    A settlement between the District Attorneys of Los Angeles, Riverside, San Bernardino, and Orange Counties and Pacifica Hosts, Inc. includes a Supplemental Environmental Project (SEP) in which air filtration systems would be supplied to schools within Environmental Justice (EJ) Communities. South Coast AQMD has been requested to administer the SEP. Further, unspent school air filtration SEP funds of $45,000 from a South Coast AQMD settlement with the California Attorney General previously recognized by the Board need to be reallocated to Los Angeles Unified School District (LAUSD). These actions are to: 1) recognize up to $40,000 from the settlement between the District Attorneys and Pacifica Hosts, Inc. into Air Filtration Fund (75) to implement a school air filtration SEP; 2) authorize the Executive Officer to execute agreement(s) not to exceed $81,000 with the LAUSD  to install or maintain air filtration systems in schools within EJ Communities; and 3) reimburse the General Fund from the Air Filtration Fund (75) for administrative costs up to $4,000 for implementing the school air filtration projects.   • 6. Recognize Revenue, Transfer Funds, Execute Contract for Electrification of Balboa Island Ferries and Installation of Supporting Charging Infrastructure, and Reimburse General Fund for Administrative Costs

    South Coast AQMD received an award of $8,297,548 for the electrification of Balboa Island Ferries and installation of supporting charging infrastructure under CARB’s FY  2021-22 and FY 2022-23 Advanced Technology Demonstration and Pilot Projects Solicitation. These actions are to: 1) recognize up to $8,297,548 from CARB into Clean Shipping Technology Demonstration Special Revenue Fund (83); 2) transfer up to $250,000 for South Coast AQMD’s project cost-share from Clean Fuels Fund (31) and up to $7,664,396 as a temporary loan from Rule 1111 Air Quality Investment Fund (27) into Clean Shipping Technology Demonstration Special Revenue Fund (83); 3) execute a contract with Balboa Island Ferry in an amount not to exceed $7,914,396 for the electrification of Balboa Island Ferries and installation of supporting charging infrastructure; and 4) reimburse the General Fund up to $633,152 from Clean Shipping Technology Demonstration Special Revenue Fund (83) for administrative costs necessary to implement this project.     On October 6, 2023, the Board approved the release of an RFP to In October 2023, the Board approved the release of an RFP to obtain short- and long-term systems development, maintenance, and support services. This action is to execute new contracts to obtain these services on a task order basis. Executing contracts with multiple bidders provides a pool of well-qualified professionals who have demonstrated their understanding of and expertise in meeting agency needs and enables South Coast AQMD to obtain cost-effective and technically responsive support.     South Coast AQMD uses Zoom services to hold virtual and hybrid meetings. The current subscription and support are set to expire on June 8, 2024. This action is to obtain approval for the sole source purchase of Zoom subscription and support for one year from Information Management’s FY 2023-24 Budget, in an amount not to exceed $125,000.   • 10. Execute Agreement with California High-Speed Rail Authority Setting Forth Framework for Development of Future Contract to Reduce Construction Emissions and Satisfy General Conformity for Palmdale to Burbank Project Section of California High-Speed Rail Project

    The California High-Speed Rail Authority must demonstrate General Conformity to receive federal funding through the Federal Railroad Administration’s High-Speed Intercity Passenger Rail program. In order to demonstrate General Conformity, construction emissions must be below de minimis emissions thresholds. The California High Speed Rail Authority seeks to sign and execute a letter with the South Coast AQMD to agree to negotiate a future contract to reduce construction emissions and to provide funding to the South Coast AQMD for mitigation of the remaining emissions. The agreement would apply to the electrically-powered Palmdale to Burbank Project Section of California High-Speed Rail Project. In November 2021, the Board approved a similar agreement between California High Speed Rail Authority and South Coast AQMD for the Burbank to Los Angeles Project Section. This action is to approve execution of an agreement with the California High-Speed Rail Authority setting forth a framework for development of a future contract to reduce construction emissions for General Conformity for the Palmdale to Burbank Project Section of the California High-Speed Rail Project.     As part of their FYs 2021-24 Work Program, the MSRC approved an RFP for MSRC Programmatic Outreach Services for January 2025 through December 2027. Additionally, the MSRC approved a modification to a contract under the Local Government Partnership Program as part of their FYs 2016-18 Work Program. At this time, the MSRC seeks Board approval of the contract modification and to release the RFP as part of the FYs 2016-18 and 2021-24 Work Programs.     The Executive Officer's Proposed Goals and Priority Objectives, and Proposed Budget for FY 2024-25 have been developed and are recommended for adoption. Proposed Amended Regulation III includes: an increase of most fees by the Consumer Price Index (CPI) of 3.5 percent; new or modified fees which are necessary to provide more specific cost recovery for regulatory actions taken by the agency including major incident response actions and to promote cleaner technologies, as well as a proposal to increase most permit related fees by 1.5 percent per year for two years beyond CPI; and administrative changes in Regulation III that include clarifications, deletions, insertions, or corrections of existing rule language, which have no fee impact. This action is to adopt the Resolution: 1) Determining that the proposed amendments to Regulation III – Fees are exempt from the California Environmental Quality Act; 2) Amending Regulation III - Fees; and 3) Adopting the Executive Officer’s Proposed Goals and Priority Objectives, and Proposed Budget for FY 2024-25. Members of the public are afforded an opportunity to speak on any agenda item before consideration of that item. Persons wishing to speak may do so in person or remotely via Zoom or telephone. Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under the Public Comment Period may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record.
